Terms of Service

These Terms of Service (“Terms”) govern your access to and use of AgentMailMagic, operated by AgentMailMagic Inc.. By creating an account, placing an order, or otherwise using AgentMailMagic, you agree to these Terms.
The service
AgentMailMagic lets real estate professionals create AI-personalized direct-mail campaigns — we generate, print, mail, and track postcards on your behalf. Plans, included volumes, and per-card pricing are described on the pricing page and in your order confirmation.
Accounts
You are responsible for any activity that occurs under your account, for keeping your credentials secure, and for ensuring all information you provide to us is accurate, current, and complete. You must be at least 18 years old to use AgentMailMagic.
Payment, subscriptions, and refunds
- One-time charges (e.g. Proof Pack) are due in full at checkout.
- Subscription plans renew automatically on a monthly cycle until canceled. You may cancel at any time before the next billing date; cancellations take effect at the end of the current billing period.
- Add-on cards beyond your monthly included volume are billed at the per-card rate on your plan.
- We refund the campaign cost for any batch that does not land at its intended addresses. Refund requests for other reasons are evaluated case-by-case.
Mailing content; your responsibilities
You are solely responsible for the content of your mailings, including any disclosures, license numbers, or disclaimers required by your jurisdiction or licensing board. You represent that you have the legal right to mail to each recipient on your list and that you will honor opt-out and do-not-mail requests promptly. You will not use AgentMailMagic to send mailings that are unlawful, deceptive, defamatory, harassing, infringing, or that target protected classes in a discriminatory manner.
Compliance with laws
You agree to comply with all applicable federal, state, and local laws and regulations, including but not limited to the Fair Housing Act, the Telephone Consumer Protection Act, state Do Not Call rules, state real-estate solicitation rules, USPS bulk-mail standards, and applicable privacy laws.
Intellectual property
We retain all rights, title, and interest in AgentMailMagic, including the underlying software, designs, and templates. You retain ownership of the content and lists you upload. You grant us a worldwide, non-exclusive license to use that content as needed to provide the service.
Disclaimers
AgentMailMagic is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Direct-mail response rates and outcomes vary by market, list quality, and offer; we make no guarantees about results.
Limitation of liability
To the maximum extent permitted by law, AgentMailMagic Inc. and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our aggregate liability arising out of or relating to these Terms or AgentMailMagic will not exceed the amounts you paid us in the twelve months preceding the event giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless AgentMailMagic Inc. from any claims, damages, or expenses arising from your mailing content, your violation of these Terms, or your violation of any law or third-party right.
Termination
You may cancel your subscription at any time. We may suspend or terminate your account if you breach these Terms, fail to pay, or use AgentMailMagic in a way that creates legal or operational risk for us or others.
Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. Any dispute will be brought in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.
